Great article. We could benefit from the Center's participation in the fairness hearing process to inject some real objectivity in the process. I wish I was aware of your work years ago. I have been representing a number of non profit medical associations objecting to a settlement involving Horizon Blue Cross in New Jersey. After intial approval the appellate court sent it back for a more robust fairness hearing to consider whether a settlement in which Horizon promises to comply with existing state law and pays the class attorneys 6.5M is fair.
